Terms of Use
Effective 27 August 2026.
Flywhen is a forecast-based planning aid. It is not flight clearance, an aviation authority, an official aviation weather source, or a guarantee that any flight, application or other operation is safe, legal, permitted, effective or suitable.
1. Agreement
By accessing or using Flywhen, you agree to these Terms of Use. If you do not agree, do not use the service. These terms apply to the website, installed web app, forecasts, charts, task profiles, alerts, explanations and related pages.
2. What Flywhen provides
Flywhen organizes third-party forecast data and user-selected thresholds to support planning. Labels such as GO FLY, Good to fly, marginal or grounded describe the result of Flywhen's configured forecast checks. They do not authorize an operation and do not replace your own assessment.
3. Forecast and data limitations
Forecasts can be inaccurate, incomplete, delayed, unavailable, stale or interpreted incorrectly. Model resolution can miss terrain, buildings, trees, water, convection and other local effects. Conditions can change after a forecast is produced or between nearby locations.
Some values are calculated or estimated from other data. Wind at altitude may use a nearby model level or interpolation. Cloud base, visibility, satellite availability, GPS lock, density altitude, sun position and task guidance all have limitations. A displayed value or positive result is not proof of actual conditions.
4. Your responsibility
You are solely responsible for deciding whether, where, when and how to operate. Before and during every operation, you must independently check everything relevant, including:
- current conditions at the actual site and along the complete route
- official weather, airspace, NOTAMs, restrictions and permissions
- applicable laws, regulations, certificates and operating authorizations
- the aircraft and controller manuals, serviceability, maintenance, batteries and payload
- people, property, obstacles, terrain, visibility, communications and emergency procedures
- whether conditions remain suitable throughout the operation
You must stop or avoid an operation whenever safety may be compromised, regardless of what Flywhen displays.
5. No professional or regulatory advice
Flywhen does not provide aviation, meteorological, legal, regulatory, agricultural, pesticide, engineering or other professional advice. Rules differ by country, region, aircraft, operation and authorization. You must consult qualified professionals and the responsible authorities when needed.
6. Spraying and other task profiles
Task profiles are planning aids only. Spraying guidance does not determine whether an application is legal, safe or effective. The specific product label, current local rules, trained operator judgment, on-site measurements and any required authorization control. You are responsible for drift, crop, environmental, property and regulatory consequences.
7. Third-party services
Flywhen depends on services and data supplied by third parties, including Open-Meteo and government or public data sources. Those providers may change, interrupt, delay or discontinue data. Their terms and policies apply to their services. Flywhen does not control or guarantee them.
8. Availability and changes
The service may change, become unavailable or be withdrawn at any time. We may correct data, models, thresholds, wording or features without notice. You are responsible for reviewing the current display and these terms each time you rely on the service.
9. Disclaimer of warranties
To the maximum extent permitted by applicable law, Flywhen is provided as is and as available, without representations, conditions or warranties of any kind, whether express, implied or statutory. This includes warranties of accuracy, completeness, timeliness, availability, reliability, merchantability, fitness for a particular purpose, non-infringement and suitability for any operation.
10. Limitation of liability
To the maximum extent permitted by applicable law, Flywhen and the people involved in operating it will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss, or for loss of profit, revenue, data, opportunity, contract or use arising from or connected with Flywhen.
To the maximum extent permitted by applicable law, this includes claims involving injury, death, aircraft loss or damage, damage to other property, crop or environmental damage, missed or delayed operations, regulatory action, fines, or decisions based on inaccurate, incomplete, delayed, unavailable or misunderstood information.
To the maximum extent permitted by applicable law, total aggregate liability arising from or connected with Flywhen will not exceed the greater of the amount you paid for Flywhen in the twelve months before the event giving rise to the claim and CAD 100.
Nothing in these terms excludes or limits liability, warranties, remedies or rights that applicable law does not permit to be excluded or limited.
11. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Subject to any mandatory rights that apply to you, the courts located in Ontario will have exclusive jurisdiction over disputes connected with these terms or Flywhen.
12. Severability and no waiver
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver of it.
13. Changes to these terms
We may update these terms as the service changes. The effective date at the top identifies the current version. Continued use after an update means you accept the updated terms.
